GUERNSEY’s Right-of-Way services include the following:

  • Prepare and design necessary right-of-way based on the needs of the project
  • Conduct minimum 50-year title search
  • Prepare misery (ownership) information
  • Review legal documents to determine ownership
  • Prepare legal descriptions and plot plans
  • Prepare Fair Market Value (FMV) reports or Master Addendums to generate a fair market value for the land acquisition
  • Contact property owners and negotiate settlements, including cost to cure items such as fencing, corner sets, producing fruit trees, barns, homes, water wells, driveways, septic systems, vineyards, etc.
  • Assist in condemnation activities
  • Assist in home relocation activities

Issues GUERNSEY often encounters and assists with during the design, acquisition and utility relocations:

  • Difficult or hostile land owners and negotiations
  • Engineering design change recommendations due to difficult acquisition aspects
  • Discovered independent O&G producers were using existing drainage pipes to cross the highway
  • Property ownership discrepancies and family disputes
  • Title and legal description discrepancies
  • Multiple heirs
  • Agricultural Concerns:
    - Acquisition of vineyards
    - Loss of producing pecan trees
    - Fencing issues due to livestock
    - Private trophy / hatchery fishing ponds

GUERNSEY's utility relocation efforts have included the following elements:

  • Identified affected utility owners
  • Distributed construction plans and conducted field meetings to determine solutions
  • Reviewed utility owners' plans and proposals for moving utilities
  • Provided easement acquisition as needed
  • Prepared work orders and assisted with the engineering of the relocations
  • Processed claims for payment as necessary

Examples of locations for which GUERNSEY has provided land services:

Client: Oklahoma Department of Transportation
Location: Highway 75, Hughes County, Oklahoma

Two miles of Highway 75 near the town of Wetumka. This project required the acquisition of 39 parcels due to the widening of State Highway 75. 

Client: Calpine Corporation
Location: Wagoner County, Oklahoma

Fifteen miles of a large diameter pipeline carrying cooling water to its proposed plant site and a smaller diameter pipeline for potable water and fire service. This project required the acquisition of 105 parcels and required the purchase of 15-foot easements running parallel to section line roads owned by the county.

Client: Oklahoma Department of Transportation
Location: Highway 99, Lincoln County, Oklahoma

Approximately 15 miles of Highway 99 near the town of Prague. This project required the acquisition of 140 parcels due to the widening from two lanes to four lanes of State Highway 99.

Client: Oklahoma Department of Transportation
Location: Highway 1, Johnston County, Oklahoma

Approximately 12 miles of Highway 1 between the towns of Mill Creek and Ravia. This project required the acquisition of 68 parcels due to widening of this two-lane highway. This project required coordination efforts with the railroad.
