Environmental Site Assessments
When considering the sale or purchase of property, potential owners should be aware of possible environmental liabilities that are, or may have been, associated with the property in question. Using guidelines set forth in the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), GUERNSEY can assist in identifying possible contamination on properties that are being considered for sale or purchase. An effective Environmental Site Assessment (Phase I, II, III ESA), conducted on the property prior to purchase or sale, will help limit future liabilities for the potential buyer. The process determines if prior site uses have resulted in a contaminated environment or if apparent environmental issues have been remediated and site conditions are in compliance with current environmental regulations.
An ESA is the formal process used to determine if a particular parcel of real property (including improvements) has recognized environmental conditions. Recognized environmental conditions are the presence, or likely presence, of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release or a material threat of a release into structures on the property or into the ground, groundwater or surface water of the property.
